Accidental Amendment

No great prolifer but, always said that if we return a legal person to the womb, it will retain that status -- along with millions of its similarly situated brothers
and sisters.  Naturally enough, I was intrigued by the story of the returned 13 week fetuses.

There on the facing page was an artist rendition of Planet Earth  --missing, as was de riguer for the pre-space age, CLOUDLESS!
🙂😂   What a metaphor!   The most highly technical and artistically  creative people cannot see from the outside-in.

I always say that if we reoved a fully developed fetus from its womb and then returned it, it would  retain its legal person status; along with all similarly situated fetuses.

PRE-ARTIFICIAL SATELLITE PICS OF EARTH NEVER SHOW CLOUDS
My attention wandering to the facing pae I viewed a =n image of the Earth from space Typicall for its era -- no clouds.  What a perfect metaphore.  Millions -- billions -- never think of what is above in the sky.

COUPLE OF  NIGHTS AGO I HAD THIS REAL DREAM -- OUR PROTAGONIST SHOT AND KILLED A DOCTOR STOP HIM FROM IMMEDIATELY KILLING A 20 WEEK GESTATION HUMAN FETUS WHO HAD NOTHING WRONG WITH HIM MEDICALLY.

HIS LEGAL DEFENSE WAS TO CALL HARVARD LAW PROFESSORS TO TESTIFY THAT THE FETUS A LEGAL PERSON  IT WORKED

What defines a "legal person"?  Until my "jury:" close physical contact with society and being a human being.  Since my "jury": just being human qualifies.

Mmm.  Wonder if we might not stumble unto  the 13th Amendment along the way?  Dare a progressive professor to say it does not.

Don't go thermonuclear.  Won't save the child.  And everyone else will let loose on us (and the  next children).   Boalt professor Tom Noonan depicted a scene of 20 week execution in his book "The Private Choice."

If nothing else, high tech is catching up to prenatal reality.  Comes the day the  examining doctor can interact with a fetus just like today ...  .  Slavery died because if we tapped a key in Maine it's brother in Paris would tap at the same time.  Ditto for steam powered locomotion.

Psychologically, the medium is the message.  Give each late fetus a legal name:  make it legal person

what would Abraham  Lincoln have said about the 13th Amendment connection?   A baby is a baby is a baby.

Brief history of murky thinking about  prenatal rights.

Future Dean of  Stanford La,w John Hart Ely, criticism :  "The Wages of Crying Wolf'" -- detailing how the Court had been blamed unfairly for years for just ignoring the Constitution and doing whatever it wanted --s o  that if actually did nobody would notice.

Most quoted-forever Lawrence Tribe quoted Ely's much quoted "definition for a syllogism."

Tribe: "One of the most curious things about Roe is that, behind its own verbal smokescreen, the substantive
basis on which it rests is nowhere to be found."
